Terms of Service

1. Acceptance of Terms
By accessing or using FinderSeek ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform. FinderSeek reserves the right to update these terms at any time. Continued use after changes constitutes acceptance.
2. Description of Service
FinderSeek is a real-money treasure quest platform where users ("Pirates") hide prizes in public locations and create AI-powered clues, and other users ("Seekers") follow those clues to find and claim the prize. FinderSeek facilitates the quest creation, clue delivery, prize claim, and optional escrow payment between parties.
3. Eligibility
You must be at least 18 years old to use FinderSeek. By creating an account, you represent that you are of legal age in your jurisdiction. FinderSeek is currently available in the United States only. Users are responsible for complying with all local laws regarding outdoor activities, public spaces, and prize claims.
4. User Accounts
You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate information during registration. FinderSeek reserves the right to suspend or ban any account that violates these terms, engages in fraud, fails to honor prize commitments, or behaves in a manner that endangers others.
5. Quest Creation (Pirates)
As a Pirate, you agree to:

Safe Locations Only โ Hide prizes in public, well-lit, accessible locations during daylight hours. Never hide prizes near private residences, schools, daycares, restricted areas, or unsafe locations.

Honor Your Prize โ If using Honor Code, you commit to paying the winner promptly upon claim. Failure to pay may result in account suspension.

Accurate Descriptions โ Provide truthful descriptions of the prize, hiding location, and neighborhood. Misleading quests will be removed.

Weatherproofing โ If hiding physical cash, use weatherproof protection (envelope, zip-lock bag) to preserve the prize.
โ ๏ธ FinderSeek reviews all quests before they go live. Quests that violate safety guidelines will be rejected. Repeated violations result in permanent account ban.
6. Prize Claiming (Seekers)
To claim a prize, you must physically locate the hiding spot and submit the correct 6-digit code. First correct submission wins โ there are no ties. Once claimed, the prize is yours. FinderSeek is not responsible for the condition of physical prizes found at hiding locations.
7. FinderSeek Escrow
When a Pirate selects FinderSeek Escrow, the prize amount plus a 10% service fee is collected via Stripe at the time of quest creation.
๐ฐ How Escrow Works:
โข Prize funds are held by FinderSeek until a winner claims the quest.
โข Upon valid claim, FinderSeek pays the winner via Zelle, Venmo, or CashApp within 24 hours.
โข If no winner claims the prize before the quest expires, the prize amount is refunded to the Pirate's original payment method. Refunds typically appear within 5โ10 business days depending on your bank.
โข The 10% service fee is non-refundable regardless of outcome.
8. Honor Code Payments
When a Pirate selects Honor Code, FinderSeek does not collect or hold any funds. The Pirate is solely responsible for paying the winner directly. FinderSeek provides an in-app chat to coordinate delivery but is not liable for non-payment under Honor Code quests. Pirates who fail to pay winners will have their accounts suspended.
9. Fees & Payments
FinderSeek charges a 10% service fee on Escrow quests. This fee covers payment processing, AI clue generation, platform maintenance, and customer support. All payments are processed securely through Stripe. FinderSeek does not store credit card information. Prices are in US dollars.
10. Prohibited Conduct
You agree not to:
๐ซ Hide prizes on private property, near schools/daycares, in vehicles, or in unsafe/dark areas
๐ซ Create fraudulent or misleading quests
๐ซ Claim prizes using codes obtained through hacking, social engineering, or any means other than physically finding them
๐ซ Create multiple accounts to circumvent bans or manipulate the platform
๐ซ Harass, threaten, or endanger other users
๐ซ Use the platform for any illegal activity
๐ซ Reverse-engineer, copy, or redistribute FinderSeek's code, design, or systems
11. Intellectual Property
All content on FinderSeek โ including but not limited to the name, logo, design, code, AI-generated clues, and user interface โ is the intellectual property of FinderSeek and is protected by copyright law. You may not copy, reproduce, modify, distribute, or create derivative works from any FinderSeek content without prior written consent. AI-generated clues created through the platform are owned by FinderSeek.
12. Limitation of Liability
FinderSeek is provided "as is" without warranty of any kind. To the maximum extent permitted by law, FinderSeek shall not be liable for:
โข Personal injury or property damage incurred while participating in quests
โข Lost, stolen, or damaged prizes at hiding locations
โข Non-payment by Pirates using Honor Code
โข Disputes between Pirates and Seekers regarding prize delivery
โข Service interruptions, data loss, or platform unavailability
โข Any indirect, incidental, or consequential damages arising from use of the platform
You participate in quests at your own risk. FinderSeek strongly recommends seeking prizes only in safe, public locations during daylight hours. Never trespass on private property or enter areas where you feel unsafe.
13. Privacy
FinderSeek collects your email address, display name, and city for account functionality. We do not sell your personal information. Payment data is processed by Stripe and is never stored on FinderSeek servers. We use Resend for transactional emails (quest notifications, winner alerts). By using FinderSeek, you consent to receiving these operational communications.
14. Account Termination
FinderSeek may suspend or terminate your account at any time for violation of these terms. If you have an active Escrow quest at the time of termination, the prize amount (minus service fee) will be refunded. You may delete your account at any time by contacting
finderseek1@gmail.com.
15. Dispute Resolution
Any disputes arising from these terms or your use of FinderSeek shall be resolved through binding arbitration in Montgomery County, Texas, under the rules of the American Arbitration Association. You waive any right to participate in a class action lawsuit against FinderSeek.
16. Governing Law
These terms are governed by the laws of the State of Texas, without regard to conflict of law principles.
